WHEREAS, the Charter
of the City of Dania Beach, Part III, Article 3, Section 4, Subsection (j),
authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established
monetary threshold without competitive bidding and without advertisement for
bids if he is authorized to do so in advance by a resolution adopted by the
City Commission; and
WHEREAS, the Dania Beach Code of
Ordinances, Chapter 2, Article 1, Section 2-10, “Monetary thresholds for
certain purchases and payment disbursement authorizations”, Subsection (a),
sets the monetary threshold or limitation at $25,000.00; and
WHERAS, the Broward Metropolitan Planning
Organization (MPO), has funding available from federal and state sources to
promote ITS “Lane Elimination” program; and;
WHEREAS, the Broward MPO and the Florida Department
of Transportation (FDOT) evaluated the program as a candidate for state and
federal funding; and
WHEREAS, the City Commission of the City of Dania
Beach recognizes the economic and social benefits of lane elimination and
associated street improvements that would result from this program; and
WHEREAS, at the February 10, 2015 meeting the City
Commission approved a resolution expressing the City’s initial support for
the program; and
WHEREAS, a feasibility study was prepared with
City, public, FDOT and MPO involvement, and the results of the feasibility
study were submitted to the MPO and FDOT; and
WHEREAS, the MPO and FDOT approved the feasibility
study and recommended the East Dania Beach Boulevard Lane Elimination project
as part of the program for further consideration for future funding and
appropriation; and
WHEREAS, the next step in the lane elimination
project process for East Dania Beach Boulevard involves the finalization of
the feasibility study, additional traffic studies, public involvement,
conceptual designs plans and a report that will be submitted to the Broward
MPO and FDOT; and
WHEREAS, the City Public Services and Community
Development Directors have determined that it is necessary to contract for
general professional engineering services related to East Dania Beach
Boulevard Lane Elimination Program at a cost not to exceed Thirty Nine Thousand
Nine Hundred Sixty Dollars ($39,960.00); and
WHEREAS, these engineering services
were unanticipated and not budgeted in the FY 2016 Commission approved
budget; and
WHEREAS, the Public Works and Community
Development Departments seek approval to appropriate funding and ratify
expenditures for these costs and to enter into an agreement with Carnahan,
Proctor and Cross, Inc.;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing “WHEREAS”
clauses are ratified and confirmed as being true and correct, and they are
made a specific part of and incorporated into this Resolution by this
reference.
Section 2. That Resolution 2015-153
dated December 8, 2015 and Resolution 2015-119 dated October 13, 2015; as
well as agreements dated January 8, 2016 and October 26, 2015 respectively,
pertaining to the Resolutions, are rescinded and repealed.
Section 3. That the proper City
officials are authorized to execute a contract for professional engineering
services with Carnahan, Proctor and Cross, Inc. pertaining to East Dania
Beach Boulevard Lane Elimination Program in an amount not to exceed Thirty
Nine Thousand Nine Hundred Sixty Dollars ($39,960.00).
Section 4. That funding for these
engineering services in the amount of $39,960.00 will be made available in
the Community Development Engineering Account 001-15-01-515-31-30 through a
budget transfer from the following accounts: 001-15-01-515-48-10 (Promotional
Activity: Community Development) $13,320.00; 001-39-06-541-52-10 (Gas &
Diesel: Public Services) $13,320.00; 001-12-01-512-31-10 (Professional
Services: City Manager) $13,320.00.
Section 5. That all resolutions or
parts of resolutions in conflict with this Resolution are repealed to the
extent of such conflict.
Section 6. That this Resolution shall
be in full force and take effect immediately upon its passage and adoption.
